Our Terms & Conditions

Ingredients

All our edible products are made by us and are subject to the following Terms & Conditions.

All cakes, fillings, icings, frostings and sweets may contain or come into contact with soy, wheat, dairy, nuts, or other allergens.

It is the responsibility of the customer to inform us prior to the confirmation of their booking of any allergy issues. It is the responsibility of the customer to inform their guests of all allergy information, this will be provided as a leaflet on delivery or collection of products and accordingly the supplier will not be held liable for any allergic reactions resulting in consumption of cakes or products.

Once you have confirmed there is an allergy, we will work with the client to provide a cake or sweets that are suitable for their needs.

All cake products are made to be eaten within three (3) days of the celebration. Sweets are to be consumed by their use by date that will be provided for each individual sweet.

Quotations

All quotations are valid for seven (7) days from the date of issue.

Orders

We prefer at least twenty-one (21) days’ notice for sweets, flowers and decor displays and at least fourteen (14) days' notice for cakes, as we are continually booked in advance.

We will however endeavour where availability and wholesale delivery permits, accept short notice cake, flower, decor displays and sweet orders.

Any cake products ordered from a picture or photo of a product produced by any other cake maker can only be reproduced by us as our interpretation of that product and will not be an exact reproduction of the product in the picture or photo.

We promise to do everything in our power to provide cake, sweets, flowers and/or decor displays for your event that exceeds your expectations, we will work with you on every level to make sure you are completely satisfied and happy with your order.

Deposit 

A non-refundable deposit of 25% is required to hold your date.

Where we have delivered what is quoted and invoiced, but the customer does not accept the finished product, the deposit WILL NOT be refunded. The customer can choose to pay the remainder and take the product(s) or leave them at no extra cost.

Unforeseen circumstances

Where we cancel the booking due to illness or other unforeseen circumstances that affects the ability to deliver the ordered product, the full amount including deposit will be refunded within seven (7) days of notification to the customer.

Final balance payments and pick-ups

The balance is due on the date of pick-up for cakes, and before the product(s) leave the premises or deliverer leaves the venue if being delivered and two weeks prior to date for event planning, sweets, flowers and decor displays, a reminder will be sent a few days before.

If paying by cash, correct change is appreciated, as we may not have the exact change on the premises.

If paying by internet/ bank transfer, the money needs to hit the account on the agreed payment date or BEFORE the product leaves the premises or deliverer leaves the venue.

It is the responsibility of the customer to check the state of the product before leaving the premises, if happy they will sign a release form, this will stand for any nominated person who is receiving the products on the customers behalf.

Once the item has left the premises if anything happens to the products after the exchange, we are not liable for any damages, the customer is responsible for ensuring the product(s) get to their destination safely and is stored as per our instructions to achieve the best results for taste and/or quality.

Delivery

We offer delivery, delivery is charged at our discretion.

Delivery will be carried out in a safe and appropriate manner. Once delivered to the customer and change of hands has been completed with the product in appropriate condition, it is then up to the customer to store and care for the products as per the instructions. If anything happens to the products after this exchange, we are not liable for any damages.

A delivery date and time will be agreed by both parties, and if the customer is not at location at this time and date and we are unable to contact the customer, the product(s) will be transported back with us to the premises, and it will be the customers responsibility to collect the product(s).

Publication and marketing

We reserve the right to use any images of a product made by us for publication and marketing at a later date.

Return of hired equipment

A deposit will be taken on top of the hire fee for all equipment. All equipment must be returned on agreed date, or extra charges may be levied to cover hire costs.

Any damages to equipment will incur a reduction or loss of deposit returned to customer in order to cover costs or repair or replacement.

Damage 

If a third party will be collecting the cake or flowers on the customers behalf, a release form is to be signed by the nominated person, stating the cake is received in a good condition at the time of pick-up or delivery.

Pick-up for cakes and flowers

The customer is liable for any damage, accident or mishap that may occur once the product is released from the care and custody of the suppliers ie the release form is signed and the product has left Chalk & Winters Co premises.

The supplier is not liable for any damage that may occur thereafter.

Decor will be by delivery only as we will set up the display on the equipment that we hire out to the customer.

Refunds/ cancellations/ postponement policy

Postponement

If for any reason the event is required to be postponed, please contact us immediately, the new date proposed will be subject to availability.

Cancellation/ refund

If cancellation of the order is required and you have paid your full balance the refund policy is as follows:

If the cancellation is up to one month in advance of your event date, you will receive a refund, less your initial deposit and the cost of any supplies already purchased for your order.

If the cancellation is less than twenty-one (21) days prior to your event, there will be absolutely no refund given.

Refunds will be paid within thirty (30) days of cancellation.

Any non-refunded balance may be credited towards future purchases.
